Job Title: Estate Litigation Attorney
Job Summary: As an Estate Litigation Attorney, you will specialize in handling legal matters related to disputes arising from wills, trusts, estates, and inheritance. You will provide legal representation to clients involved in contentious probate proceedings, estate administration disputes, trust litigation, and contested guardianship matters.
Responsibilities:

Client Consultation: Meet with clients to understand their concerns and objectives regarding estate matters. Provide legal advice and assess the merits of potential litigation based on the facts and applicable laws.

Case Evaluation: Review estate planning documents, including wills, trusts, and powers of attorney, to identify potential issues or ambiguities that may lead to disputes. Analyze relevant legal precedents and statutes to evaluate the strengths and weaknesses of clients' positions.

Litigation Strategy: Develop effective strategies for resolving estate disputes through negotiation, mediation, or litigation. Advise clients on the potential risks, costs, and benefits of pursuing legal action and advocate for their interests in court proceedings.

Legal Research and Analysis: Conduct legal research to support arguments and motions in estate litigation cases. Stay current with developments in probate law, trust law, and related areas to provide informed guidance to clients.

Document Preparation: Prepare pleadings, motions, briefs, and other legal documents necessary for estate litigation proceedings. Ensure that all filings comply with court rules and procedural requirements.

Discovery and Investigation: Gather evidence through discovery mechanisms such as interrogatories, requests for production, and depositions. Interview witnesses, review financial records, and analyze documentary evidence to build a compelling case.

Court Representation: Represent clients in probate court hearings, trials, and other judicial proceedings. Present oral arguments, examine witnesses, and cross-examine opposing witnesses to effectively advocate for clients' positions.

Settlement Negotiations: Engage in settlement negotiations with opposing parties and their attorneys to explore potential resolutions outside of court. Negotiate favorable settlement agreements that address clients' objectives while minimizing the time and expense of litigation.

Client Communication: Maintain regular communication with clients to keep them informed of case developments, respond to inquiries, and address concerns promptly. Provide realistic assessments of potential outcomes and manage client expectations throughout the litigation process.
Qualifications:
- Juris Doctor (J.D.) degree from an accredited law school.
- Admission to the state bar and in good standing with the relevant jurisdiction.
- Prior experience practicing estate law, probate law, or litigation preferred.
- Strong knowledge of probate procedures, trust administration, and estate planning principles.
- Excellent analytical, negotiation, and advocacy skills.
- Ability to manage multiple cases simultaneously and prioritize tasks effectively.
- Attention to detail and strong written and verbal communication skills.
- Commitment to upholding ethical standards and maintaining client confidentiality.
